Huawei, the largest telecommunications equipment company in China, filed a proceeding with the Federal Communications Commission (FCC) of the US government on February 8 in the 5th Circuit Court of Appeals in Louisiana.

Huawei said in a complaint that the FCC designated the company as a national security threat "beyond the FCC's job authority, without evidence of concrete evidence, and in violation of the United States Constitution." We are calling for a review of the FCC's judgment.

This is actually the second time the company has filed a proceeding against the FCC. In November 2019, the FCC decided to ban American companies from purchasing telecommunications equipment and services from Huawei and ZTE using federal subsidies to protect national security.

In response, Huawei filed a lawsuit in December 2019, alleging that the FCC's decision violated the US Constitution and the Federal Administrative Procedure Act. The trial of the first proceeding is still ongoing.

Consistently continuing legal struggle against the U.S. government

After that, FCC further strengthened the elimination of Huawei. In December 2020, an American telecommunications carrier decided to invest at least $ 1.6 billion to remove and replace the already installed Huawei and ZTE telecommunications equipment. .. The second proceeding is Huawei's countermeasure against this decision.

Huawei has consistently continued its legal struggle as US government sanctions escalated. The first lawsuit filed a complaint in March 2019 that the US government's fiscal year 2019 Defense Authority Act included restrictions on the procurement of Huawei's communications equipment and services by government agencies.

But two months later, in May 2019, the US Department of Commerce added Huawei to its entity list. Invoked a de facto embargo sanction. Furthermore, in February 2020, Huawei lost a lawsuit in the National Defense Authorization Act and was unable to overturn the US government's procurement restrictions.

However, not all court battles have ended in vain. In June 2019, Huawei sued that it was illegal for a subordinate agency of the Ministry of Commerce to seize the equipment in the name of export inspection when sending back the communication equipment tested at the American laboratory to China. After that, the US government responded to the return of the equipment, and Huawei withdrew the proceedings.
